To restrain influence through the fixation of a shoe and a friction surface of a drum caused by freezing.
In this brake fixation detecting device, a strut 28 regulates a mutual interval between a first shoe 12 and a second shoe 14 when the respective abutting parts 12e and 14e of the first shoe 12 and the second shoe 14 abut on abutting object parts 28a and 28b arranged in respective both ends when a parking brake is released. A return switch detects a return from a push-contact position with the friction surface 22a of the drum 22 of the first shoe 12 and the second shoe 14, by detecting the approach of the abutting part 14e of the second shoe 14 and the abutting object part 28b of the strut 28. An ECU determines that the first shoe 12 or the second shoe 14 is fixed to the drum 22 when the return from the push-contact position of the first shoe 12 or the second shoe 14 is not detected when the parking brake is released.
